Welcome to promptTech connect. This agreement sets forth the Terms of Use, Privacy Policy, and Rules and Regulations applicable to users accessing or using the PromptTech Connect.
PromptTech operates globally through its various associates, subsidiaries, and affiliated companies. Collectively, these entities are referred to as "PromptTech" throughout this Agreement.
We are committed to providing a wide range of services tailored to meet your unique needs. Whether you're looking for cutting-edge software solutions, reliable hardware products, or any other services, our goal is to offer comprehensive, high-quality offerings that empower your success.
Through our Connect App, you can easily access and explore our offerings, with a seamless user experience that connects you to the services that best suit your needs.
Your use of the promptTech connect is governed by the following terms and conditions ("Terms of Use") as applicable to the promptTech connect including the applicable policies which are incorporated herein by way of reference.
User Consent and Acknowledgment
By using the App, you acknowledge and agree that any and all activities, transactions, or communications carried out through your account, whether performed by you or any person authorized or otherwise having access to your account, shall be deemed to have been conducted with your full knowledge and consent. The Company shall not be liable for any loss or damage arising from unauthorized use of your account.
To access and utilize the PromptTech Connect App, PromptTech will create an account for you, granting access to all available services and features.
Termination We may suspend or terminate your access to the Connect App at any time, without prior notice, for any reason, including if you breach any provision of this Agreement. Upon termination, your license to use the Connect App will immediately cease, and you must stop using the Connect App and delete any copies from your device.
You may also terminate this Agreement by ceasing to use the Connect App and uninstalling it from your device. Any outstanding obligations or payments owed by you at the time of termination will remain due and payable..
Privacy and Data Collection
Our Privacy Policy details how we collect, use, and share information you provide when using the App. By using the App, you consent to the data practices described therein. Specifically, we collect and process data necessary to provide enterprise solutions, including business information, user details, and usage patterns. This information is utilized to enhance our services, offer customer support, and deliver personalized features
You agree to provide accurate and complete data, and to promptly update such information as necessary.
Data security : Clients are responsible for maintaining regular backups of their data when using services. PromptTech is not liable for any data loss, business interruptions, or damages resulting from the use or installation of its services. Additionally, PromptTech disclaims responsibility for data breaches caused by external factors, cyber-attacks, or unauthorized access. Ensuring adequate data backups and security measures remains the client's responsibility.
Service Terms
Each service we offer is governed by specific terms or any specific terms related to the nature of the service, duration, maintenance, or warranty information which shall be outlined in the respective agreements.
These terms will detail everything from the scope of service and deliverables to pricing and support. By using our services, whether via the Connect App or through any other channels we provide, you agree to be bound by these terms.
For your convenience, we encourage you to carefully review the terms and conditions associated with each service to ensure you fully understand the scope and responsibilities before engaging with our offerings.
Support Services
Support services will be provided by PromptTech Global with prioritization based on the tickets raised through the app. Support requests will be handled on a case-by-case basis according to the priority of the ticket raised in the Connect App.
Third-Party Services
When using PromptTech Connect, you may access services provided by third parties, such as insurance providers or local service partners. Your use of these third-party services is subject to their own terms of use, privacy policies, and any applicable fees or payment terms. PromptTech is not responsible for any loss, damage, or liability arising from your use of such third-party services. For any service that integrates or relies on third-party providers, their respective terms and policies will apply.
Intellectual Property: All content, software, logos, graphics, trademarks, and intellectual property related to the Connect App are owned by PromptTech.You are granted a limited, non-exclusive, non-transferable license to use the Connect App for the purpose of accessing and using the enterprise solutions offered by the App. You shall not copy, modify, distribute, or create derivative works based on any part of the Connect App without prior written consent from us.
License Grant: We grant you a personal, non-transferable, non-exclusive license to use the Connect App. You may only use the Connect App for lawful purposes and in compliance with all applicable laws and regulations.
You shall be responsible for all the necessary statutory approvals to operate the services as required and also for covering any license fees incurred for third-party content used in conjunction with the services. PromptTech collectively shall not be responsible for any such approvals or clearances from respective govt. Bodies or institutions.
User Obligations as a user of the App, you agree:
Not to misuse or interfere with the operation of the Connect App or disrupt other users' access.
Not to reverse-engineer, decompile, or disassemble any portion of the Connect App.
To keep your account information confidential and secure.
Not to use the Connect App for any illegal or unauthorized purposes.
Disclaimer
By accessing and using the Connect App, you acknowledge and agree that you do so at your own risk. You are solely responsible for exercising due diligence and prudent judgment before engaging in any transactions through the Connect App.
PromptTech shall not be liable or responsible for the actions, inactions, representations, or warranties of any third party, including sellers and manufacturers of products. We expressly disclaim all responsibility and liability in this regard. PromptTech will not mediate or resolve disputes between users and third parties, including sellers or manufacturers.
Your use of the Connect App is entirely at your own risk. PromptTech does not control or assume responsibility for how users or third parties interact with the services.
The Connect App and its services are provided on an "as is" and "as available" basis, without any express or implied warranties. To the fullest extent permitted by law, PromptTech disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from the course of dealing or usage of trade.
Limitation of Liability: To the fullest extent permitted by law, PromptTech Connect shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to this Agreement or your use of the App. Notwithstanding anything to the contrary in our terms, in such cases, the liability of Connect App will be limited to the fullest extent permitted by applicable law.
Modifications to the Terms and Conditions: We reserve the right to update, modify, or revise these Terms and Conditions at any time. Any changes will be effective upon posting in the Connect App. Your continued use of the Connect App after such changes signifies your acceptance of the revised terms.
Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. However, any mandatory provisions of applicable laws that cannot be lawfully excluded shall apply to the extent required in the user’s jurisdiction.
All disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the competent courts in India, unless otherwise required by such mandatory laws.
Miscellaneous
PromptTech Connect continually enhances its services, which may involve adding, modifying, or discontinuing features and functionalities. Service interruptions may occur due to maintenance, upgrades, or unforeseen events beyond our control, such as natural disasters.
Unless a separate agreement exists, these Terms constitute the entire agreement between you and PromptTech, superseding any prior agreements. We reserve the right to designate certain services under separate terms, which will be communicated accordingly. Any amendments or waivers proposed by you require our express consent. These Terms do not confer any third-party beneficiary rights. Failure to enforce any provision does not constitute a waiver. If any provision is deemed unenforceable, it will be amended to the minimum extent necessary, and the remaining provisions will remain in effect. We reserve all rights not expressly granted to you.
